1. Introduction

These Terms and Conditions govern the relationship between Lantern Cove (referred to as "we," "us," or "the residence") and residents, family members, and legal representatives (referred to as "you" or "families") who engage with our residential care services.

By choosing Lantern Cove for residential care or by using our website to inquire about services, you agree to be bound by these terms.

2. Definitions

For the purposes of these Terms and Conditions:

  • Resident: An individual who has been accepted for residency at Lantern Cove and occupies accommodation at our facility
  • Family Member: A person designated by the resident or legal representative as an authorized contact
  • Service: Residential care, accommodation, meals, activities, and support provided by Lantern Cove
  • Agreement: The formal residency contract entered into between Lantern Cove and the resident or legal representative
  • Fee: The monthly payment required for chosen care services

3. Acceptance and Admission

3.1 Eligibility

Lantern Cove provides residential care for elderly individuals who:

  • Are 60 years of age or older
  • Do not require intensive medical or nursing care
  • Can benefit from a supportive residential environment
  • Are able to participate in daily life with appropriate assistance

3.2 Assessment Process

Before acceptance, we conduct an assessment to ensure our services align with the prospective resident's needs. This assessment may include:

  • Discussion of health history and current status
  • Review of mobility and daily living capabilities
  • Evaluation of dietary requirements
  • Consideration of personal preferences and expectations

3.3 Admission Agreement

Upon acceptance, a formal agreement will be signed outlining the specific services to be provided, fees, payment terms, and other relevant details. This agreement takes precedence over these general terms where specific provisions differ.

4. Services Provided

4.1 Scope of Services

Lantern Cove provides the following services based on the care option chosen:

  • Accommodation in shared or private rooms
  • Three balanced meals per day
  • Assistance with personal care and daily routines
  • Access to shared spaces and garden areas
  • Housekeeping and laundry services
  • Optional nature immersion programs and activities
  • Optional personal aide support for suite residents

4.2 Services Not Provided

Lantern Cove is not a medical facility and does not provide:

  • Intensive nursing care or medical treatment
  • Specialized dementia or Alzheimer's care programs
  • Physical therapy or rehabilitation services
  • 24-hour medical supervision

Residents requiring such services should make their own arrangements with external healthcare providers.

5. Fees and Payment

5.1 Monthly Fees

Monthly fees are charged based on the care option selected:

  • Cove-Side Room Residency: ฿14,500 per month
  • Nature Immersion & Community Program: ฿14,000 per month
  • Coastal Retreat Suite with Personal Aide: ฿82,500 per month

5.2 Payment Terms

Payment is due in advance on the first day of each month. Accepted payment methods include bank transfer and cash.

5.3 Late Payment

Late payments may result in suspension of optional services until payment is received. Continued non-payment may lead to termination of residency.

5.4 Fee Adjustments

We reserve the right to adjust fees annually with 60 days written notice to residents and families.

6. Resident Responsibilities

Residents and their families agree to:

  • Provide accurate and complete information about health status and needs
  • Notify staff promptly of any changes in health or circumstances
  • Respect other residents, staff, and shared spaces
  • Follow reasonable residence guidelines and safety protocols
  • Maintain payment obligations in a timely manner
  • Inform us of any concerns or issues that arise
  • Participate cooperatively in assessment reviews when requested

7. Health and Medical Care

7.1 Coordination with Healthcare Providers

While Lantern Cove staff monitor resident wellbeing, residents are responsible for maintaining relationships with their own doctors and healthcare providers. We will coordinate with these providers as needed with appropriate authorization.

7.2 Emergency Situations

In medical emergencies, we will contact emergency services and notify designated family members immediately. Any costs associated with emergency medical care are the responsibility of the resident or family.

7.3 Change in Care Needs

If a resident's care needs change significantly and exceed what Lantern Cove can appropriately provide, we will work with families to arrange transition to a more suitable care setting.

8. Visiting and Family Involvement

Family members and authorized visitors are welcome throughout the day and evening. We ask that visitors:

  • Respect the privacy and comfort of other residents
  • Observe quiet hours during late evening and early morning
  • Coordinate extended visits or overnight stays with staff
  • Follow any health and safety protocols in effect

9. Termination of Residency

9.1 Voluntary Termination by Resident

Residents or their legal representatives may terminate residency with 30 days written notice. Payment is required through the notice period.

9.2 Termination by Lantern Cove

We may terminate residency under the following circumstances:

  • Continued non-payment of fees despite notification
  • Resident's care needs exceed our capabilities
  • Behavior that endangers other residents or staff
  • Material breach of the residency agreement

We will provide 30 days notice when possible and assist with transition planning.

9.3 Refunds

Monthly fees are not prorated. In cases of death or emergency relocation, unused portions of the current month's fee may be refunded at our discretion.

10. Liability and Disclaimers

10.1 Standard of Care

We provide residential care services with reasonable skill and attention. However, we cannot provide guarantees about specific outcomes or prevent all accidents or health incidents.

10.2 Limitation of Liability

Lantern Cove is not liable for:

  • Loss or damage to personal belongings unless due to our negligence
  • Health incidents that occur despite reasonable precautions
  • Choices made by residents regarding their own care
  • Acts or omissions of third-party healthcare providers

10.3 Insurance

Families are encouraged to maintain appropriate insurance coverage for residents, including health insurance and personal property insurance.

11. Privacy and Confidentiality

We maintain confidentiality of resident information in accordance with our Privacy Policy and Thai data protection laws. Please refer to our Privacy Policy for details on how we handle personal information.

12. Dispute Resolution

12.1 Informal Resolution

We encourage families to raise concerns directly with our staff or management. Most issues can be resolved through open communication and mutual understanding.

12.2 Formal Process

If informal resolution is not successful, written complaints may be submitted to the Residence Director for formal review and response within 14 days.

12.3 Governing Law

These Terms and Conditions are governed by the laws of Thailand. Any disputes will be resolved in Thai courts with jurisdiction over Phang Nga Province.

13. Changes to Terms

We may update these Terms and Conditions periodically to reflect changes in our services or legal requirements. When significant changes are made:

  • Current residents and families will be notified in writing
  • The updated terms will be posted on our website
  • Changes will take effect 30 days after notification

Continued residency after the effective date constitutes acceptance of updated terms.
